NEPA Challenges: Lessons from North Dakota

The U.S. District Court for the District of Columbia recently approved a Supplemental Environmental Impact Statement for North Dakota’s Northwest Area Water Supply Project after more than 13 years of litigation in Gov’t of Manitoba v. Zinke. This case, brought by Canada’s Province of Manitoba and the State of Missouri, addressed important issues under the National Environmental Policy Act (NEPA). Resolving this NEPA challenge allowed a critical infrastructure project to provide safe drinking water to 80,000 people in northwest North Dakota to move forward.

Join WCEE to hear from Nessa Horewitch Coppinger, Principal at Beveridge & Diamond PC, who argued this case before the U.S. District Court and the Court of Appeals on behalf of North Dakota. She will discuss what she sees as the major takeaways from this case for projects requiring environmental reviews under NEPA (and thus subject to potential NEPA challenges) and for practitioners handling NEPA challenges.

Nessa Horewitch Coppinger is a Principal at Beveridge & Diamond PC.
